摘要：

Private Militär- und Sicherheitsunternehmen haben einen wachsenden Einfluss auf die moderne Kriegführung. Dies wirft Fragen nach ihrer Einordnung im Gefüge des Völkerrechts auf. Entgegen einer verbreiteten Ansicht sind Private Militär- und Sicherheitsunternehmen keine Söldner und bewegen sich nicht in einem „juristischen Vakuum“. Zur Beseitigung bestehender Unsicherheiten müssen die Staaten aber ihrer Pflicht zur Durchsetzung des (humanitären) Völkerrechts konsequent nachkommen.
