This article aims to defend the proposition that the right to access justice is based on the duality of the general and particular. This means that, in principle, no one can be excluded from the enjoyment of this right, and at the same time, procedural arrangements must be in place so that anyone can effectively exercise this right. The article is primarily theoretical and offers discussion on the background of two concepts, namely equality and vulnerability. Despite its speculative nature, the considerations have practical implications as they suggest a way of thinking about the right of access to justice in practice, including objections to possible violations of this right. © 2022, ERA.
