摘要：

The criterion of restitution of profits aims at preventing any benefits illegally accrued from remaining among the assets of the infringer. Thus, the profit that the owner of the infringed right could have made through its exploitation is irrelevant for determining the applicability of this compensation criterion. What is relevant is the profit that the infringer has made through encroachment on a right which assigns to its owner the pecuniary profits that can be obtained with it.
