The Occupational Health and Safety Act, based on British legislation, regulates occupational health and safety in South Africa. In terms of common law every employer is responsible for the health and safety of his employees. The Act expounds the duties of the employer and the employee clearly, it is self regulatory and it binds the State. The duties of the CEO and the duties that he can assign to others are given. In terms of the Act the employer is presumed to have committed a wrongful act unless it is proven that someone else has committed the act without authorization.
