摘要
This article aims to analyse the legal treatment of the mandatum pecuniae credendae in the time of Emperor Justinian and to determine whether the figure still made sense in the legal practice of the time or it was just included in the Justinian Code only because of the classicist zeal of the Emperor. It also aims to clarify how the equalization made by Justinian between fideiussores and mandatores influenced the doctrinal treatment of the Ius commune, time when different theories about the nature of the credit mandate emerged.
