The Development of Liability Insurance under the New Tort Liability Law

There are close relations and mutual influence between liability insurance and tort law. This paper studies the liability insurance development direction in the future under the background of the new tort law implementing. Firstly we show the dialectical relations between the tort law and liability insurance, and point out the perfection of tort law is the basis for the development of liability insurance, but the liability insurance will in turn constraints and fixed tort law system. Secondly we compare the differences between the old and new tort law in our country, and discusses the potential impact on the development of liability insurance. Thirdly we studies some specific issues of new tort law system, including punitive damages, infringement of fuzzy as well as the confirmation of compensation for mental injury. The last part we propose six suggestions including setting up the accident responsibility system on the future development of liability insurance.
