REMARKS ON EUROPEAN UNION AND INTERNATIONAL LAW CONCERNING THE WOLF (CANIS LUPUS) AND ITS APPLICATION TO SPANISH LAW

This contribution examines European Union (EU) and international rules concerning wolves (canis lupus) as Spanish Law 42/2007, on the Natural Patrimony and Biodiversity refers to such rules for the inclusion of certain protected species in the so-called List of Specially Protected Wild Species created by this law. Nevertheless, the Law is not very clear regarding the notion of "protected species". In the case of wolves, it is therefore necessary to analyse their position in such European and international law instruments and certain key protection notions, such as "favourable conservation status". The contribution considers the CJEU case law regarding that concept and the global assessment set out in the EU EIONET network, which evinces that such status is unfavourable.
