TRANSFORMATION OF THE LEGISLATION ON CULTURE IN THE CONTEXT OF DIGITALIZATION

Introduction: the article deals with cultural policy in the context of the concept digital cultural heritage' of the global information society and considering the need for legal understanding and regulation of the rapid digitalization in the field of culture. Purpose: to analyze the place of digital heritage, the problems of its legal regulation and to formulate recommendations for improving the system of legal regulation of digitalization in the sphere of culture of the Russian Federation, to identify positive aspects and indicators of the development. Methods: interdisciplinary, comparative, axiological and normative methods. The interdisciplinary approach allowed us to overcome the conventional boundaries between the legal, information and technical, cultural and other spheres in the problem area; the normative method was used in the monitoring of international and national legislation in the field of cultural policy. Results: the created strategic documents on digitalization of Russian society, in particular those in the field of culture, require legal regulation and effective mechanisms for their implementation; therefore, interdisciplinary research and legislative measures are necessary. It has been revealed that the use of traditional knowledge in everyday life would preserve the axiological value of intangible heritage and would allow actualizing and promoting traditional culture. At the same time, the ethnic diversity and traditional culture of the local population as a cultural resource of a region could enhance its territorial attractiveness, as well as reduce the damage to the cultural interests of the ethnic group by bringing distorted information to the public, which is why the processes of digitalization and commercialization of intangible culture should be implemented on the basis of an interdisciplinary scientific approach. Conclusions: it seems appropriate to work out and implement a number of measures in the field of development and digitalization of culture: at the federal level - adoption of the federal law on culture aimed at increasing the role of cultural values, the idea of patriotism and Russian identity for the population; creation of legal conditions for the formation of a single digital cultural environment; at the level of subjects of the Russian Federation - improvement of economic and legal regulation of digital culture.
