THE EVOLUTION OF CONSUMER PROTECTION INSTRUMENTS IN THE FIELD OF UNFAIR CONTRACT TERMS

Over the last decades contractual relations have displayed a rapid ongoing development from a substantial stand point, which over the course of time proved to be too complex for consumers that legislative action was necessary. History acknowledged the role of the European consumer in achieving a true Common market rather slowly, after a few decades it was recognized as a European policy and as priority for legislative harmonization. In 1993 the Council Directive 93/13/EEC was adopted and marked the turning point for consumer protection and also the premise for a cross-border cooperation which would lay down the blue print for one of the most ambitious scientific instruments, which would serve citizens, professionals and researchers. The aim of this article is to analyze how the CLAB database served as an instrument against unfair terms and how such a system would be of use against the current day legal challenges of unfair terms in Romania.
