What is anti-social behaviour?

This article offers a definition of the behaviour that creates liability to an ASBO. It argues that s. 1 of the Crime and Disorder Act 1998 organises criminal liability by means of a determination of individual citizenship status that relies on communitarian categories of positive duty, relationship and character. It explores the contrast between this conceptual structure and the existing criminal law, and the consistency of ASBO proceedings with the civil procedure.
