"END-OF-LIFE SITUATIONS": EUROPEAN COURT OF HUMAN RIGHTS' AMBIGUITIES AND INACCURACIES

摘要
In the Spanish legislative drafts in favour of decriminalisation/regulation of euthanasia, the European Court of Human Rights jurisprudence is not used as an argument or is misunderstood. Maybe because this Court has not favorably decided the vast majority of cases in which it is called upon to consider, but also, as we defend in this paper, because the ambiguities and inaccuracies of its jurisprudence do not allow to deduce clear standards which support the domestic positions (in favour of, or in opposition to euthanasia). These ambiguities and inaccuracies do not justify getting by without of same one when it comes to interpretating, to applying and to producing legal rules.
