INTEGRATION IN INNOVATION SPHERE OF EURASIAN ECONOMIC UNION: LEGAL ASPECT

摘要
The subject of research is the national and supranational legislation of countries members of the Eurasian Economic Union (EAEU) in the sphere of innovations and innovation activity in the context of interstate integration in Eurasian region. The research was done on the basis of a complex approach, comparative method and the principle of methodological pluralism. The novelty of scientific decisions is determined by the conduct of urgent and comprehensive research in the light of basic tendencies of modem integration processes development. The analysis of legislation on innovation activity includes acts of the EAEU (The Treaty on the Eurasian Economic Union of 29.05.2014), acts of the Eurasian Economic Community (Decision of the Interstate Council of the EAEC of 11.12.2009 No 475 "On Conception on the formation of Eurasian innovation system"), acts of the Commonwealth of Independent States (Model Innovation Code, 2014; model laws "On technical parks", 2012; "On scientific parks", 2013; "On public-private partnership", 2014, etc.) and laws of countries-members of the EAEU (the Russian Federation, the Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan, the Republic of Kyrgyzstan). The study of the Russian Federation legislation covers both federal and regional levels (for example legislation of Moscow). The conclusion is made about the insufficient level of legal base systematization of countries-members of the EAEU regulating the innovation activity, the absence of clear definitions of an object of regulation and identity of terminology, approaches to the composition of innovation activity subjects, which are conditioned by the complex and multiple-aspect character of the legal relationship under study. In current legislation the separate norms on innovative activity are uncoordinated and provided for different acts; the interconnection of innovative and industrial infrastructure is not defined. The results of the research are presented in the form of proposals of the unification and harmonization of legislation on the innovation activity in countries-members of the EAEU. It seems necessary to work out the Legal Basics of the EAEU on innovations and innovation activity, which will be directed at determining common terminology, forms of the countries' cooperation in the sphere of innovation, optimal schemes of innovative technologies transfer and financial mechanisms of interaction. The results of the research can be applied in the field of legal and economic sciences, in the spheres of state administration and activity of supranational organs of the EAEU.
