In R. v. Chief Constable of Sussex, ex p. International Trader's Ferry the House of Lords considered the impact of Community law upon the exercise of operational discretion vested in the police. This article examines the House of Lords' ruling together with some related caselaw of the European Court of Justice in order to explore the increasingly significant influence of Community law over policing and criminal justice policy more generall.
