CAN COPPA WORK? AN ANALYSIS OF THE PARENTAL CONSENT MEASURES IN THE CHILDREN'S ONLINE PRIVACY PROTECTION ACT inspects the adequacy and effectiveness of the verifiable parental consent mechanisms in the Children's Online Privacy Protection Act. After outlining the arguments for and against COPPA's parental consent measures, this essay ultimately concludes that COPPA contains mechanisms which are: (a) inadequate to protect children who provide personal information online; (b) unduly burdensome both financially and administratively on online service providers whose servers host website content; (c) arguably in violation of the free speech rights granted by the First Amendment of the Constitution, and a fortiori, may be unconstitutional.
