摘要
With the proliferation of email in the past two decades, courts have traditionally granted employers wide latitude in monitoring employee communications. However as electronic communication media continue to evolve, the factors relevant in determining the appropriateness of monitoring have begun to shift. This paper reviews four key court cases, three involving web-based messaging and one with text-messaging. Taken together these cases may begin to signal the legitimacy of selected employee privacy claims with new communication technologies.
