摘要
Following the recent STS 24 February 2020 (RJ 2020,486), the High Court has consolidated its jurisprudence doctrine that qualifies the contract for the provision of legal services between a client and his lawyer as a consumer relationship, where the client meets the legal status of a consumer. The main consequence of such a statement is the possibility of applying the consumers and users' protection rules in this sector to regulate various aspects and issues related to the provision and execution of legal services. For years such has been the interpretaction by our courts of instance, which, even before the landmark STJUE 15 January 2015 -subject C-537/13- (TJCE 2015,5), have proposed the application in this field of various protective mechanisms established in the TRLGDCU. This paper is precisely focused on the analysis of the main legal question marks raised over this transfer of the provision of legal services to the consumers' law area.
