摘要：

Ever since the political turnabout in Romania in 1989, debate has continued on a new fundamental codification of the Criminal Code. This article illustrates the current reform of the criminal law against the backdrop of its historical development. It calls attention to the disproportionality that exists between the continuous debates on the reform of the criminal law on the one hand and the criminal law's extremely modest implementation on the other, which has in the meantime resulted in its symbolic application.
