Sentencing in cases of serious crime in China An analysis of robbery cases

摘要：
The sanctioning practice of Chinese mid-level courts is analyzed using the example of (aggravated) robbery. A high degree of consistency between the length of prison term imposed and the circumstances mentioned in the judgment is found (R2 similar to .8). The same applies in principle to the chosen sentencing range. Though in very aggravated cases it was difficult to predict on basis of the circumstances mentioned in the judgment which of the possible alternatives 10-15 years' imprisonment, life imprisonment, and the death penalty was chosen. In addition, significant regional differences in the severity of sanction imposed are found.
