The research of intellectual property in the electronic commerce

As a new mode of trade movement and operation, electronic commerce has been an important part of international trade. Its rise causes many problems to the current intellectual property right system. Whether we can successfully solve these problems will have a directl influence on the development of electronic commerce. First, this paper introduces what electronic commerce is and how electronic commerce developed in the latest several years. Second, the authors discuss the intellectual property right in the electronic commerce. The authors describe the intellectual property right in the electronic commerce based on five aspects such as copyright, patent right, trademark right privacy right and anti-unfair competition, analyze the tortuous phenomenon by investigating some image examples to explain it, discuss the ipacts of the tortious actions on the development of electronic commerce. At last, the authors propose to solve the problems of intellectual property right in electronic commerce based on three aspects such as unifying technical standards, changing and perfecting the current intellectual laws-and taking business strategy.
