Public information policy - Does the government reach legal boundaries when steering consumer behaviour?

摘要
The government keeps trying to influence the behaviour of consumers by recommending products, the use of which - although fully complying with legal requirements - is expressis verbis or implicitly advised against. The most recent example being the introduction of a deposit on cans. From a constitutional point of view, this behaviour is questionable. In contrast to warnings against unhealthy or environmentally critical products, there is no legitimate reason for such information strategy. Product recommendations by the government could therefore undoubtedly be anticonstitutional interventions in, above all, the basic right of occupational freedom.
