摘要
Terrorism, a scourge with profound and serious consequences on society, is perhaps the greatest threat to common values and principles of liberty, democracy, respect for the rule of law, fundamental rights and freedoms, facing mankind in this century. One of the most cruel ways in which terrorism is carried out by biological weapons, which, because of the gravity of the consequences and devastating effects generated guarantees a minimum rate of survival. Weapons of mass destruction, contrary to the principles of international humanitarian law, their use in armed conflict is prohibited by enrolling them in the category of war means, with non-discriminating effect, affecting both combatants, military objectives and civilian population and property. Considering these aspects, we intend to analyze this issue from the perspective of how efforts to combat terrorism and attempts to be constituted in an effective legislative framework of the fundamental rights and liberties and imposing restrictions considered to be legitimate aimed at eliminating the threat.
