THE STRUGGLE FOR HUMAN RIGHTS IN A LOCAL CONTEXT: REFLECTIONS ABOUT THE METHODOLOGICAL CHALLENGES IN A SOCIOLEGAL RESEARCH

摘要
As an alternative to the legal theoretical approaches normally used by legalists or formalists for the analysis of social phenomena in socio-legal research, in this article, the results of the methodological and empirical reflections emanating from a previous qualitative investigation will be presented, in the that the author used as a methodological strategy "field observation", differentiated from the generic "participant observation". In this investigation, the resistance process led by three social organizations that have their range of action on the periphery of the Commune 8 of Medellin was analyzed for the claim of the right to the city and the territory for this population, in the midst of the works that included the execution of one of the flagship projects of the municipal administration of Anibal Gaviria (2012-2015): the Metropolitan Green Belt - Circunvalar Garden. Through this analysis it was possible to demonstrate a constant tension between the local and the global and, a joint work between socially based organizations to resist a hegemonic conception of globalization and build a right "from below".
