摘要：
China's environmental protection laws are only from the compulsory control point to order that local governments are the responsible subject in ecological environmental protection. Therefore, it is responsible for the quality of ecological environment under its own jurisdiction area. The laws, however, are lack of necessary legal support to use market mechanism and economic means to carry out ecological compensation and promote the environmental protection. This has become the most prominent issue. In the absence of legal system, a lot of compensational subjects have not formed consciousness of responsibility, while as an ignored attitude to face the ecological environment compensation in reality. The main role of institutional guarantee in eco-tourism resources' value compensation mechanism is to solve the question "how to guarantee compensation".
