Are Geographical Indications sustainable in the face of climate change?

摘要
The EU is fostering sustainable agriculture. Geographical Indications (GIs) are important in EU agriculture. One justification for GIs is the unique relationship between climate and quality - terroir - in a geographic area. Terroir-based GIs are implicitly sustainable. Relationships in terroir, however, assume constant climate. Climate change can alter these relationships, including sustainability. Economic viability may require new terroir-based production practices. GIs are, however, legal constructs whereby terroir is codified. Thus, altering agronomic practices requires amending legal definitions. This paper explores the legal, agronomic and economic facets of climate change for GIs. It finds that policymakers and GI rights holders may find climate change challenging.
