SUPERVISION OF PROBATION MEASURES AND ALTERNATIVE SANCTIONS IN THE EUROPEAN UNION. CRITICAL REMARKS

In this paper we examined the provisions of European legal standards governing the supervision of probation measures and alternative sanctions imposed in another EU Member State, being formulated a series of critical remarks. The paper continues some previous research conducted in the judicial cooperation domain in criminal matters in the European Union, published in specialized national or international journals or proceedings. In addition to general examination of the legal rules governing the surveillance activity of probation measures and alternative sanctions in EU Member States, the research results are reflected in the critical examination of some provisions and proposals de lege ferenda. The research conducted may be useful to teachers and researchers in the field, especially practitioners, given the need of applying the provisions of European legislative act by the Romanian judicial authorities. The essential contribution and originality of research consists of examining the general provisions of the European legislative act, commenting and proposing to amend and supplement certain provisions that may cause difficulties in practice.
