The Attribute of the Oral Statement of Accomplices or Co-defendants as Evidence

The oral statement in China is different from that in the western countries. Controversies on the attribute of accomplices and co-defendants have existed for a long time. This article thinks that the oral statement of accomplices has dual attribute. When it is to prove the person's own crime, it is the oral statement; when it is to prove the crime of other people, it is the testimony of a witness. Separation of the proceedings can not be the criterion to differentiate a defendant from a witness. Nor can the situation about whether conflicts of interests exist between the accomplices, which can only serve as a factor to judge the proof of the testimonies.
