摘要：

Pre-emption right is a right that has had an amazing evolution in Romania after 1989. The definition of this law evolved in the different regulation laws, the New Civil Code will make this determination once and for all and establish the significance of this notion. This article presents the definitions given to this right, the modalities in which the notion of pre-emption evolved in terms of doctrinal opinions, as well it is presented the vision that the New civil code has in connection with it.
