Promotion and protection of human rights and the necessary counter-hegemonic construction: possibilities of decolonial paths

Much is being addressed about the instruments for the promotion and protection of Human Rights, based on the description and analysis of the formal systems created within the framework of the United Nations and regional organizations, as well as the internalized instruments arising from these. It turns out that it is not only these legitimate systems the only ways of Human Rights promotion and protection. In this sense, this article aims to discuss which ways of promotion and protection of the subjects of a State can in fact contribute to the construction of a more complex and effective Human Rights system. Only from this discussion, it is possible to set a space of counter-hegemonic constructions for the promotion and protection of human rights, in particular a decolonial construction.
