Settlement of Disputes Over Foreign Energy Investment in China-From the Perspective of ICSID

Over 30 years since the reform and opening up, especially over 15 years since the accession to the WTO, China has achieved rapid economic development and ushered in a new era of capital export. Foreign energy investment is not only the practical need for China's development, but more importantly, is a future long-term measure. Therefore, protection of the legitimate rights and interests of China's foreign energy investment companies is an issue of high concern. Based on the current situations of foreign energy investment and dispute settlement via the ICSID in China, this paper analyzes the problems Chinese investors may face in resolving disputes via the ICSID and puts forwards suggestions for better utilization of the ICSID mechanism accordingly.
