摘要：
This paper deals, under the point of view of the differentiation between fundamental rights and guarantees, the legal nature of the important administrative improbity suit, whether civil, criminal or mixed, bringing the different positions of doctrine and jurisprudence on the subject, as well as the consequences inherent to legal nature. All without losing sight of the main objective of the Administrative Improbity Law, which is: to fight corruption, sanctioning this serious conduct, to the extent of its gravity, but always respecting due process of law, among other constitutional rights and guarantees.
