摘要：

As a new legal institution, if we refer to its legal regulation in the Romanian Civil Code, the engagement raises numerous controversies related to the legal effects generated by its contracting, particularly to those related to its abusive breaking. This article aims at debating upon the part of the issues that may arise in practice in relation to the abusive breaking of the engagement, compared to the opinions of the French theorists and of the rich French case-law.
