Definition and Attribution of the Intellectual Property of Agricultural Research Achievements

By using the theory of management and knowledge of law, this paper researches the issues of unclear attribution of intellectual property between the institute and its management departments, and, between the institute and its staff which exists in provincial agricultural research institutes. Through adopting the normative and theoretical research paradigm and with reference to the attribution of foreign intellectual property changes, the paper concludes that in present time the precondition to strengthen intellectual property protection in provincial agricultural research institutes is to clarify the, attribution, and the main measures for that are: to separate appropriately the ownership and the right of intellectual property access; encouraging intellectual property innovation of scientific researchers; and using intellectual property right for social and economic development.
