Matrimonial system and equality before the law. Especial reference to marriage according to Roma rite

The purpose of this study is to analyze the matrimonial system from equality in the law. Current regulations limit the civil effectiveness of marriage celebrated in a different form from civil marriage to marriages celebrated in religious form, provided that these confessions have agreements or notorious roots. A constitutional approach allows to raise questions about whether the exclusion of this benefit to confessions simply registered or marriages held in accordance with the gypsy rite is consistent with the purpose of the law that must find its foundation in constitutional principles, are justified and proportionate. The denial of the widow's pension to the marriage celebrated according to the gypsy rite shows the injurious impact of this option of the legislator.
