MORTGAGE IN GUARANTEE OF CURRENT CREDIT ACCOUNTS

Today, banks continue to stipulate mortgages to guarantee the current account balance, which although it is a poorly defined figure, has caused one of the problems that hos always been debated in the doctrine, has been the nature of the secured obligation in this type of mortgages, as well as the basis for them. In the present study we will see if the obligation secured in guarantee is a future obligation, since what is guaranteed is the return of the final balance of the account; or it is a mortgage with a present obligation, but subject to the condition that the creditor has the credit.
