Protection of rights affected by economic and antitrust crimes through human rights lens

摘要
The affirmation of the role of criminal law in promoting accountability for human rights violations and the struggle against impunity emerges from the jurisprudence of human rights bodies. This includes the protection of economic and social rights, which are affected by crimes against the economic order, especially antitrust violations. However, the effectiveness of criminal prosecution in view of unfair competition conducts cannot be compromised in the name of a supposed economic efficiency, even because the concepts are not necessarily antagonistic. The criminal response is a way out for the effectiveness in the sanctioning of such conducts, always as a result of the affirmation of the protection of the market and also of the protection of the diffuse rights and human rights involved
