ANALYSIS AND CLASSIFICATION OF EMPLOYMENT POLICIES FOR TRANS PEOPLE IN SPAIN: EUROPEAN FRAMEWORK AND REGIONAL REGULATION

摘要
Despite the importance of the workplace as a source of economic independence and social integration, and European pressure to improve employment policies, trans people continue to suffer high degrees of socio-labour exclusion. And despite this, there are few studies that address this issue from the perspective of the political measures and actions taken in this regard. Thus, the purpose of this research lies in the analysis of all those laws on sexual diversity and gender identity that exist in Spain, with the aim of mapping and classifying the autonomous communities according to the scope of their measures. To do this, an analytical framework is built consisting of 5 indicators: positive discrimination; job placement plans; equality and non-discrimination in the workplace; research; and regulatory scope, developed in a total of 15 items. In this way, a descriptive methodological design is used with a comparative research strategy, in order to study and establish differences and similarities between the 20 regulations that make up the sample. From the analysis, 4 territorial groups are established, these are, the one that has both LGBTI law and Trans law, two others that only have LGBTI or Trans regulations and the last one, made up of those that do not have legislation on this matter. Thus, a fragmented regulatory panorama is drawn by region in which employment actions on trans people have very different scopes. The most ambitious is Aragon -with a trans job quota-, followed by the Canary Islands and Madrid, while Cantabria, Galicia and the Basque Country close the list with great shortcomings in the comparison. The specific work insertion plans for the group are one of the most agreed upon tools, also highlighting the implication of Corporate Social Responsibility (CSR) or the anti-discrimination clauses in subsidies and public contracting.
