Foreign Law in Common Law Courts of Appeal: From Hong Kong to Jersey and Cayman Islands

The treatment in common law courts of findings of the law of a foreign jurisdiction as findings of fact has been considered "peculiar". This particularly has been so with appeals against those findings. The treatment of the subject by the Hong Kong Court of Final Appeal in 2019 has now been considered by the Privy Council and accommodated in its "spectrum approach" which may now be adopted across common law jurisdictions.
