DECENNIAL LIABILITY IN WORKS CONTRACTS AND THE JORDANIAN CIVIL LAW

This research deals with the legal nature of the liability of the engineer and the contractor, its characteristics, the legal characterization of the liability of the engineer and the contractor, and whether the ten-year liability is considered contractual, tortious, or legal, and the characteristics of each. The research deals with the personal scope of ten-year liability and who the owing and owed parties are in it through the decennial liability of the parties through the works contract. The responsibility of the engineer, the contractor, and the subcontractor is discussed, as they are subject to the ten-year liability. The beneficiaries, namely the employer, the specific successor, and the general successor are dealt with, and then the conclusion and recommendations for the study are given with regards to the Jordanian Civil Code.
