摘要
In the aftermath of the International Day of the World's Indigenous Peoples, initiated by the United Nations and celebrated on 9 August each year, this article is an avenue for reflection on the better protection of the rights of these peoples in the context of extractive activities. It suggests that the acceptance in African jurisprudence of moral prejudice, in general, and that of anxiety, in particular, in the event of violation of the rights guaranteed by the African Charter on Human and Peoples' Rights, opens a breach for the reparation of the prejudice of eco-anxiety. It proposes and highlights the legal criteria that the African regional judge could apply to assess and repair the blameworthy failure of the state to guarantee the right to a healthy environment, potentially at the origin of the eco-anxiety prejudice.
