摘要
This work, supported by analytical, historical and comparative methods, aims to analyze the arguments that served as support to the Supreme Court of Justice of the Nation to determine that the personnel at the service of the Mexican Institute of Social Security, do not You can access unemployment insurance benefits at an advanced age. Mainly, based on a historical -legal analysis of social security laws and retirement and pension systems (direct sources), we believe that the resolution of the Supreme Court of Justice of the Nation provides a generalized misinterpretation of retirement from work. of the personnel that does not consider the different areas of regulatory application, as well as the diversity of legal and contractual assumptions that are present at the moment that a worker or worker at the service of the Mexican Institute of Social Security decides to retire or retire. But above all, it is about of an ahistorical resolution, which is inadmissible when an interpretation of legal and contractual regulatory provisions is made.
