摘要
This paper deals with the legal system that classical Canon Law drew for the valid alienation of ecclesiastical properties. It studies which authority had to grant the corresponding licence, and the cases in which it had to look for the advice or consent of some bodies. The reasons why Canon Law adopted these measures are studied, since it is no by chance that it coincides with the strengthening of collegiate bodies, and the spread of certain theories and principles within the Ius commune, such as the principle quod omnes tangit, which had an effect on this matter.
