THE PARTICIPATION OF THE BRAZILIAN BAR ASSOCIATION IN THE 1987-1988 CONSTITUENT ASSEMBLY AND THE DYNAMICS OF ITS INTERESTS

From the recognition of the existence of a duality of interests of the Brazilian Bar Association (OAB), which are, on the one hand, corporate interests and, on the other, general/national interests, this research was developed in order to demonstrate how the dynamics of these interests took place in the National Constituent Assembly (ANC) of 1987-88. From a historical-documentary methodological approach, we presented in the first section of the paper the participation and influence of the OAB in presenting suggestions and amendments in the ANC; in the second section, we examined the proceedings of the public hearings, which had the OAB as an invited speaker. This research gives a contribution to a better understanding of the dynamics of the OAB's interests in the Brazilian constituent process by demonstrating that the entity's strengthening resulted both from its collaboration with matters of general/national interests and from the fact that it was able to include in the text of the Constitution of 1988 yours corporate interests.
