摘要
This paper aims to construe a conception of willful blindness compatible with the criminal law of civil law countries. For this task, we use the epistemological assumptions given by the meaningful action conception, which is based upon the linguistic and pragmatic turn provided by the philosophy of the language. Based on the linguistic perspective, we are able to understand adequately the willful blindness in the context of the criminal law of civil law countries and we can perceive its value as a qualified indicative factor about the cognitive element of the mens rea. This paper considers that the theory of crime must abandon the aim of describing the "truth", instead, it should focus on the intent to make "justice".
