摘要:
The incompleteness of China’s contracting and operating right.jot rural land is, at the present stage, the ownership root of the slowness of developing rural land market; it also related to the undefinedness of its legal attribute.This incompleteness cuts the farmers’income made from operating land,lowers the dealing price of cultivated land,raises the cost thereof,reduces the net benefit from the market dealings of farmland, and finally abridges the supply and demand of farmers’s land. To quicken the commercialization of China’s farmland, we must, based on the real right theory, regulate China’s system of contracting and operating right to farmland; and by means of legal system construction and property right arrangement, uncork the bottleneck of property right system in developing China’s farmland market.
