摘要：

In April 2023, a Proposal for an EU Regulation on the transfer of criminal proceedings between Member States was made public. The text, rescuing old attempts, aims to put an end to a regulatory vagueness that makes the transfer of proceedings unattractive. The EU proposal is laudable in spirit, but flawed in some respects, which are examined here. A revision is required that expands the rights of the investigated or accused person and the victim to participate in the transfer and that is compatible with the state's interest in general prevention.
