THE RIGHT TO DIGITAL DISCONNECTION, A VIEW FROM CUBA

The development of Information and Communication Technologies has led to a change in the way of working, which has led to many workers teleworking from their homes, bringing with it the extension of their working day many more hours than those agreed in their employment contract, influencing their rest and affecting the right to digital disconnection. Although rules have been issued to regulate the right to digital disconnection, this right is not always respected. This paper analyzes the right to digital disconnection from the perspective of labor law and its implementation in Cuba and the need for its regulation. The research methods that were used in this research obey the following: Analysis-Synthesis, Deduction and Induction, Theoretical-legal analysis, exegetical-legal and the research technique of Document Review and Participant Observation.
