Expiry Reviews of Anti-Dumping Measures in the European Union

Since 1995 until 2008, 163 expiry reviews have been completed in the European Union (EU). Of these, 108 expiry reviews resulted in the continuation of the measures and 55 led to their termination. In 153 cases no expiry reviews were initiated and the measures expired automatically. The present article discusses the procedural and substantive aspects of expiry review investigations in the EU and provides a statistical overview of the expiry reviews undertaken during the past fourteen years. The last part of the article discusses the possibilities for changes in the provisions concerning expiry reviews in light of the draft texts of the Anti-Dumping Agreement (ADA) proposed by the Chair of the WTO Negotiating Group on Rules.
