SEXUAL ORIENTATION, IDENTITY OF GENRE AND CRIMINAL LAW

This paper presents the framework of criminal legal protection of LGBT. It starts with history about the criminal persecution suffered by LGBT, to current regulation, which this group has gone from persecuted by the public authorities to protected them through the criminal law. Here it analyses the words sexual orientation and gender identity - different sexual identity-, and after exposing the discriminatory crimes. It noted how confusion about sex and gender causes applicability problems of the discriminatory crimes. Finally, there is a section on gender violence, as discriminatory crime, and the controversy over this violence occurring between same-sex couples.
