ETHICAL AND LEGAL REGULATION OF MEDICINE IN RUSSIA: HISTORICAL OVERVIEW

In Russia the theoretical reflection of legal regulation in medicine has always been based on axiological foundation. In this connection it should be stressed that evaluating the condition of this regulation has been initially motivated not by legal but by ethical attitudes. This is true both for the apologists and the opponents of medical law. Specific regulations in the area of health care law existed to the degree in which (a) they were in demand and (b) they were possible without harming the polity. As a rule, the needs in legal regulation of health care outpaced the capabilities and aspirations of state authorities to develop it and put into practice. Thus it became one of the incentives to change the legislation.
