Some say today that the law is in crisis, and that the legislative activity is insufficient and ineffective with regard to the new demands of society. The liberal legalistic model, which was believed for a long time to be the essential basis of the rule of law, is no longer an element of ensuring social justice. This is a high theoretical content problem and caused by, distinct and several very complex factors. To solve this problem, it seems necessary to rescue the classic debate between legality and legitimacy, in order to try to provide diagnostic and sensible answers to new social, ethical, political and legal challenges that arise in contemporary democratic societies.
